Machu Picchu Mystical Tours reserves the right to modify tour itineraries due to weather conditions, natural disasters, accidents, health emergencies, or other unforeseen circumstances beyond our control. The tour guide maintains full authority to make necessary changes to ensure customer safety and tour completion.

4. Limitations of Liability

Machu Picchu Mystical Tours is not responsible for personal injuries, lost items, property damage, or incidents occurring during tours unless caused by gross negligence or willful misconduct. Tours involve hiking in mountain terrain at high altitude (up to 4,000 meters) and carry inherent risks. Tour participants acknowledge and accept these risks and agree to participate at their own risk.

All refund requests must be submitted in writing via email. Once approved, refunds will be processed within 10-15 business days to the original payment method. Machu Picchu entrance tickets are subject to different refund policies according to the park's regulations. Customers may request modifications to tour dates or details. Requests made more than 60 days before the tour date incur no additional fees. Requests made 30-59 days before incur a 15% modification fee. Requests made 14-29 days before incur a 25% fee. No modifications are permitted within 14 days of the tour date due to ticketing and logistics constraints.

11. Governing Law and Jurisdiction

These Terms of Service are governed by the laws of Peru. All disputes arising from these terms or tour services shall be subject to the jurisdiction of the courts in Cusco, Peru. Both parties agree to attempt resolution through good faith negotiation before pursuing legal action.
